Please see the information below as it relates to releasing DPPA protected data.  PLEASE ADVISE THIS OFFICE IF YOU WOULD LIKE A REDACTED COPY OF THE REPORT.  If you qualify under one of the DPPA exemptions a written request is required.


At the direction of the Office of the Town Attorney, the Town of Madison Police Department has temporarily removed all traffic accident reports from our website, pending the outcome of a decision issued by the Seventh Circuit Court of Appeals in Senne v. Vill. of Palatine , 695 F.3d 597, (7th Cir. 2012 en bane, cert. pet. filed 11/5/2012). The Senne decision held that under the provisions of the Driver's Privacy Protection Act (DPPA) personal identifying information derived from the Department of Motor Vehicles (DMV), including possibly names, an individual's date of birth, driver's license number, social security number, home address, home telephone number, photograph, and medical or disability information is prohibited from disclosure to the public unless one of 14 DPPA exceptions apply. All non-personal information contained within records can be released to a requesting third party. For example, personal information does not include factual information, as to where, when or how an accident occurred. The DPPA preempts any conflicting state law that regulates the dissemination of motor vehicle record information. Collier v. Dickinson, 477 F.3d 1306,1312, n. 3 (11th Cir. 2007).


The exceptions to the prohibition to disclosure under the DPPA are found at 18 U.S.C. 2721(b). Accordingly, in compliance with the Seventh Circuit Court of Appeals decision and advice from the Town Attorney's Office, the Town of Madison Police Department, like many other police departments across the state, can no longer make available accident reports that include personal information prohibited from disclosure by the DPPA unless an exception applies.

If no DPPA exception applies any member of the public may obtain a traffic accident report with personal identifying information redacted (which likely will be a substantial portion of the report) from:

You may also request a copy of the traffic accident from the WI Department of Motor Vehicles without redactions as follows:


1.         Call (608) 266-8753

2.         Send an email to: traffic-accidents.dmv@dot.state.wi.us

3.         Mail a request to: WI DMV - Uninsured Motorists Unit, P.O. Box 7983, Madison, WI 53707.


There is a $6.00 charge for this service. An invoice will be sent along with the report.


The Town of Madison Police Department is proud to make our accident reports available on-line.

Our partnership with PoliceReports.US, LLC has allowed us to place our crash reports on-line for 1100 days for each crash report.

All accident reports investigated by the department after October 21, 2007 are available with the following exceptions;

1) Fatal accidents

2) Narrative reports to accidents, but the MV4000 accident report will be available on-line


You may still obtain accident reports from the police department or via mail.  Reports obtained this way will cost $0.25 per page.  If reports are mailed the cost of mailing the reports will be added to your cost.
